1. The agreement
These Terms of Service (the “Terms”) are a binding agreement between you and Everydream, the maker of oobookoo (“oobookoo,” “we,” “us”). They govern your access to and use of the oobookoo mobile application, the oobookoo.com website, and any related features or services (together, the “Service”).
By downloading, installing, or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.
2. What oobookoo is
oobookoo is a reading companion built around physical books. You can:
- Photograph a bookshelf and have its spines turned into a digital catalog of the books you own.
- Record format, edition, condition, provenance, and other details about each book.
- Track reading progress and capture ratings, verdicts, vibes, and private notes.
- Browse curated lists of titles selected by our editors. oobookoo does not currently use AI to generate personalized book recommendations.
- Find independent bookstores near you on a map (the “Bookstore Finder”).
- Create or join invite-only bookclubs to discuss what you’re reading privately.
- Share your bookshelf or individual covers through the Covershare feature when you choose to.
The Service is currently distributed through Apple’s TestFlight beta program for iPhone (iOS 17.6 or later). Features, availability, and pricing may change as the app evolves.
3. Beta software
oobookoo is currently a beta product. That means the Service may contain bugs, behave unexpectedly, change without notice, or be unavailable from time to time. We may add, remove, or alter features, reset test data, or end the beta at any time.
By participating in the beta you agree to use the Service at your own risk and you accept that data you create during the beta may not be preserved indefinitely. Please keep your own copies of any information that is important to you, and don’t treat the beta as a backup of your physical library.
You also agree to comply with Apple’s Licensed Application End User License Agreement and the TestFlight terms, each of which applies in addition to these Terms while you access oobookoo through TestFlight or the App Store.
4. Eligibility & your account
You must be at least 13 years old (or the minimum digital-consent age in your country, if higher) to use oobookoo. If you are under 18, you must have permission from a parent or legal guardian.
You are responsible for the security of the device and credentials you use to access the Service, and for everything that happens under your account. Please notify us promptly at hello@oobookoo.com if you believe your account has been compromised.
You agree to provide accurate information when you sign up and to keep it reasonably current.
5. Your content
You retain ownership of everything you create or upload to the Service — including photos of your shelves, notes, ratings, tags, bookclub messages, profile information, and any other material (collectively, “Your Content”).
You grant us a worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, display, and process Your Content solely to operate, maintain, and improve the Service for you and, where you have opted in, the people you choose to share with. This license ends when you delete Your Content or close your account, except that we may retain copies as required by law or for a reasonable period in routine backups.
You are responsible for Your Content. You represent that you own it or have the rights necessary to share it on oobookoo, and that sharing it on oobookoo will not violate the law or anyone else’s rights.
6. Bookshelf scanner & photo processing
The Bookshelf Scanner uses computer vision and machine-learning models to identify book spines in the photos you submit and to match them against book metadata. To deliver this feature, your photos and the data derived from them (such as detected text and identified titles) are processed by oobookoo and by trusted service providers that help us run the model.
Please only photograph shelves you have the right to photograph. Don’t use the scanner to capture content that doesn’t belong to you, that you don’t want processed, or that contains other people’s personal information.
Spine recognition is imperfect. The scanner may misidentify titles, miss books, or attribute the wrong edition or cover. Please double-check results and edit them in the app as needed.
7. Bookclubs & social features
Bookclubs on oobookoo are invite-only and private by default. Conversations inside a bookclub are visible to members of that bookclub. By creating or joining a bookclub you agree to treat other members’ messages, notes, and shared content with respect, and not to redistribute them outside the club without consent.
Covershare and other sharing features are opt-in. You decide what to publish, with whom, and you can stop sharing at any time. Once you publish content outside the app — for example by sharing a cover to social media — we cannot control what happens to it.
8. Bookstore Finder
The Bookstore Finder displays information about independent bookshops gathered from public sources, our own research, and contributions from the community. Listings, opening hours, addresses, and availability change over time and may be inaccurate. Please confirm details with the shop before making a special trip.
To show shops near you, the feature uses your approximate location with your permission. You can turn that permission off in your device settings at any time; the Bookstore Finder will still work, you’ll just need to search by area manually.
9. Book metadata & third-party content
Book covers, descriptions, ISBNs, author biographies, and similar information shown in the Service come from publishers, authors, our editors, the open-book-data community, and other third-party sources. We try to keep that information accurate but we don’t guarantee it. If you find a mistake, let us know.
Covers and other publisher-supplied artwork remain the property of their respective rights holders. The Service may also link to third-party websites and services (for example, bookstore websites or App Store listings). We don’t control those sites and aren’t responsible for their content or terms.
10. Acceptable use
You agree not to:
- Use the Service to violate any law or another person’s rights, including intellectual-property and privacy rights.
- Upload content that is illegal, harassing, hateful, sexually explicit involving minors, threatening, or that depicts real violence.
- Impersonate someone else, misrepresent your affiliation, or collect other users’ information without consent.
- Reverse-engineer, decompile, scrape, or attempt to extract the source code or training data behind the Service, except where we’re required by law to allow it.
- Interfere with or disrupt the Service, probe for vulnerabilities without authorization, or use the Service to distribute malware or unsolicited messages.
- Use the Service to build a competing product, or to create a dataset for training machine-learning models without our written permission.
We may remove content or restrict accounts that we reasonably believe violate these rules.
11. Our intellectual property
The Service — including the oobookoo name and logo, the app and website code, the visual design, copy, illustrations, animations, and the underlying models and software — is owned by Everydream or its licensors and is protected by intellectual-property laws. Nothing in these Terms transfers any of those rights to you.
Subject to your compliance with these Terms, we grant you a limited, personal, non-transferable, revocable license to use the Service for your own non-commercial reading and library-keeping.
12. Copyright complaints
If you believe content on the Service infringes your copyright, please email hello@oobookoo.com with: a description of the work you believe is infringed, a link to or description of the allegedly infringing content on oobookoo, your contact information, a statement that you have a good-faith belief the use isn’t authorized, a statement under penalty of perjury that your notice is accurate and that you are the rights holder or authorized to act on their behalf, and your physical or electronic signature.
We may remove content and, for repeat infringers, terminate accounts.
13. Privacy
Our Privacy Policy explains what data we collect, how we use it, and the choices you have. oobookoo is indie and ad-free. We don’t sell your reading data and we don’t treat your books as a data product.
14. Suspension & termination
You can stop using oobookoo at any time and request deletion of your account by emailing hello@oobookoo.com.
We may suspend or terminate your access to the Service if you materially breach these Terms, if your use of the Service creates legal or security risk for us or others, or if we discontinue the Service. We’ll try to give you reasonable notice when we can.
Sections that by their nature should survive termination — including ownership, disclaimers, limitations of liability, and dispute terms — will continue to apply after your account ends.
15. Disclaimers
The Service is provided “as is” and “as available.” To the maximum extent permitted by law, oobookoo and Everydream disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Service will be uninterrupted, secure, error-free, or accurate.
We don’t guarantee that the Bookshelf Scanner will correctly identify every spine, that book metadata is complete or accurate, that the Bookstore Finder reflects every shop, or that the Service will preserve any particular piece of Your Content.
16. Limitation of liability
To the maximum extent permitted by law, neither oobookoo, Everydream, nor our directors, employees, or service providers will be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or related to your use of the Service.
Our total liability to you for all claims relating to the Service in any twelve-month period will not exceed the greater of (a) the amounts you paid us for the Service during that period or (b) US $50.
Some jurisdictions don’t allow certain limitations of liability, so some of the above may not apply to you. In that case our liability is limited to the smallest extent allowed by law.
17. Your responsibility for claims
You agree to defend, indemnify, and hold harmless oobookoo and Everydream from any claim, loss, or expense (including reasonable legal fees) arising from Your Content, your use of the Service in violation of these Terms, or your violation of any law or third-party right.
18. Changes to these Terms
We may update these Terms from time to time — for example, when we add new features or to reflect legal or operational changes. When we make material changes, we’ll let you know in the app, by email, or by updating the “Last updated” date at the top of this page. Your continued use of the Service after the changes take effect means you accept the updated Terms.
19. Governing law & disputes
These Terms are governed by the laws of the jurisdiction in which Everydream is established, without regard to its conflict-of-laws rules. Any dispute relating to these Terms or the Service that we can’t resolve informally will be brought in the competent courts of that jurisdiction, except where mandatory local law gives you the right to bring it elsewhere (for example, consumers in your country of residence).
Before filing any formal claim, please email us at hello@oobookoo.com so we have a chance to try to sort it out together.
20. Miscellaneous
If any part of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce a provision isn’t a waiver of our right to do so later. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms — together with our Privacy Policy and any in-app notices — are the entire agreement between you and us regarding the Service.
